The New York Law Journal has published an article by Harry Steinberg, entitled “Appellate Courts Find Non-Appealing Parties To Be Unappealing.”  The article deals with the rights and remedies of a party who has not filed a notice of appeal who request appellate relief during the prosecution of an appeal.  In most cases, such relief will not be available.  However, the article explores when , and under what circumstances, a non-appealing party may request, and obtain, relief notwithstanding that the party did not file a notice of appeal.  The article appeared on August 24, 2015.
