6/4/2009 A Defense Verdict On A Lead Paint Trial Attorneys: Stuart G. Glass Congratulations to Stuart Glass who obtained a defense verdict on a lead paint trial captioned Eric Rodriguez, an infant by his mother and natural guardian, Adriana Abreu and Adriana Abreu, individually, against 2894 Assets, Inc. 2894 Assets, LLC and Zephyr Realty, in the Supreme Court, Bronx County, before Justice Howard Sherman. Despite the presumption of notice of lead paint hazards, the jury found that there was no proximate cause between the child’s elevated blood lead levels and the claimed injuries. Specifically, the racially diverse jury found that the now seven year old Hispanic plaintiff was exposed to lead based hazards in the subject apartment, but held that there was no proof of a brain injury as alleged by plaintiff. |
